Bruce Prescott is an experienced
trial attorney, having spent more than twenty-three years successfully
litigating complex cases involving:

Mr. Prescott has successfully
handled cases for defendants and plaintiffs alike, in any number
of industries, including software development, peripheral technologies,
manufacturing, telephony and telecommunications, high end automobile
sales, contracting, real estate, wireless technologies, food services,
clothing and shoe production and sales, and home accessories. Although
most of his clients are closely held businesses, Mr. Prescott also
has litigated cases for publicly traded companies.
Mr. Prescott has appeared
in state and federal courts throughout California and represents
clients before the American Arbitration Association, JAMS, and the
California Department of Industrial Relations. He has handled investigations
and proceedings commenced by the Equal Employment Opportunity Commission,
the Department of Fair Employment and Housing, the Department of
Labor, the Department of Real Estate, and local environmental oversight
agencies. He has argued cases before the California Courts of Appeal
and authored a brief to the United States Supreme Court (resulting
in a unanimous 8-0 decision overturning fifty years of established
law).
Mr. Prescott’s
litigation successes include seven figure settlements in a plaintiff’s
malicious prosecution action (involving the validity of a patent)
and on behalf of a client in a business fraud suit; a multi-million
dollar verdict in a commercial fraud action; a defense verdict and
$350,000 award on the cross-complaint of an employment discrimination
complaint; favorable jury verdicts in unfair competition and security
fraud cases; and multiple defense summary judgments in state court
contract, trade secret and property line disputes.
In addition
to his litigation practice, Mr. Prescott serves as outside general
counsel to business clients, advising them at the inception about
the relative pros and cons of the available entities to choose from
(corporation, LLC, partnership, etc.), forming the chosen entity,
and providing on-going business and transactional advice. He provides
guidance on issues related to contracts, corporate governance, real
estate, environmental compliance, secured transactions, commercial
leases and bank financings. Mr. Prescott also advises employers
and executive level employees on all aspects of employer/employee
relations.
